ORDINANCE NO. 05-11
AN ORDINANCE OF THE BOROUGH OF POMPTON LAKES REPEALING
CHAPTER 24 OF THE BOROUGH CODE
WHEREAS, the Flood Advisory Board consists of ten members, nine of whom
must be residents of the Borough, with specific terms of office; and
WHEREAS, pursuant to the Borough's By-Laws, there exists a Flood
Advisory Committee with unlimited membership, which members are
appointed by the Mayor, with the consent of the
Borough Council; and
WHEREAS, the powers and duties of both the Board and Committee are as
follows:
(1) to
advise the Mayor and Council on all matters related to floods;
(2) to
provide detailed historical information of flooding in Pompton Lakes;
(3)
to offer proposals, guidance and suggestions to the Mayor and Council on
flood relief
matters;
(4)
to establish and document a detailed history of flooding in Pompton
Lakes, including but
not limited to areas, times, places and sequence of flooding;
(5)
to record a detailed history of future flooding in Pompton Lakes,
including but not limited
to dates, areas, times, places and sequence of flooding;
(6)
to record and maintain current local, state and federal flood-related
legislation and funding activities as related to Pompton Lakes;
(7) to
record and maintain current state and local flood related activities;
(8)
to advise the Mayor and Council and other municipal officials on
flood-related matters as
requested;
(9) to propose guides and procedures to the Mayor and Council on flood
relief matters.
WHEREAS, the Mayor and Council are desirous of involving many members of
the public who have shown an interest in becoming involved in a
Committee which deals with the flood issues
in the Borough, which members the present Flood Advisory Board cannot
accommodate; and
WHEREAS, there are no present members of the Flood Advisory Board.
NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Council of the Borough
of:
Pompton Lakes, County of Passaic, State of New Jersey, that Chapter 24
of the Borough Code which establishes
a Flood Advisory Board is hereby REPEALED, and the Mayor and Council
shall upon the members of the Flood Advisory Committee, which have been and
continue to be appointed by
the Mayor, with the consent of the Borough Council, on an annual basis,
for advice as to all matters
related to floods within the borough of Pompton Lakes.
If any Article of this Ordinance or its application to any person or
circumstances shall be
adjudged invalid, such determination shall not affect the remaining
provisions of this Ordinance, and
the application of such remaining provisions shall not be affected
thereby and shall remain in full force and effect, and to this end, the
provisions of this Ordinance are severable.
This Ordinance is meant to repeal any provisions of the Revised code of
the Borough of
Pompton Lakes that pertain to the Flood Advisory Board, and all
Ordinances or parts thereof
inconsistent with the provisions of this Ordinance are repealed to the
extent of such inconsistency
only.
This Ordinance shall take effect immediately upon final passage and
publication as provided
by law.
